This paper outlines the background of the Republican River compact, the Final Stipulation Settlement of 2002, and more recent compliance issues for the state of Nebraska. The main crux of the paper evaluates L.B. 701, passed by the Nebraska Unicameral last year to address these concerns in the Republican Basin, by looking at the constitutional concerns with the provisions within the bill as well as the implications of its provisions and potential alternative ways to ensure Compact compliance. Ms. Patent is a recipient of Water Resources Research Initiative assistantship funding. She has researched and written her paper as part of her assistantship responsibilities. |
