This presentation will discuss key areas of law that appear to be in flux in the aftermath of of the ISIS-sponsored attacks in Brussels, Belgium, San Bernardino, California, and Paris, France. Topics to be covered include efforts to expand European surveillance regimes and tighten border and immigration controls, while the United States considers further limits on intelligence collection. The session will also cover a discussion of the recent controversy between the FBI and Apple over the work iPhone used by Syed Farook, the San Diego shooter, including addressing the question whether Americans, and the average iPhone user are safer and more protected from unauthorized access to their electronic devices before or after Apple made clear it did not intend to provide the FBI access to the phone’s content.
